TERMS & CONDITIONS

THIS IS THE OFFICIAL AND FINAL CONTRACT BETWEEN THE CUSTOMER AND MOVINGDAYCLEANING.COM (ALSO KNOWN AS “THE CONTRACTOR”). READ THIS CONTRACT CAREFULLY, BEFORE SIGNING/ACCEPTING ONLINE.  PLEASE DON'T HESITATE TO EMAIL MOVINGDAYCLEANING.COM WITH ANY QUESTIONS. A SERVICE DATE CONFIRMATION PAYMENT IS DUE WITHIN 24  HOUR, FROM THE DATE/TIME OF THIS CONTRACT/AGREEMENT, IN ORDER TO CONFIRM ANY SERVICE DATES. 

This service contract will be in effect automatically for a total number of 30 days, starting from the date of the initial payment for service: This contract will automatically renew on the first of every month, unless a minimum of 30 days written cancellation request” is provided by The Customer, prior to the first of the month. The Customer will be responsible to make any additional monthly payment(s), if The Customer fails to provide a 30 days written cancellation notice. The Customer understands and agrees that Movingdaycleaning.com is acting as an independent Cleaning Company for providing cleaning services which may or may not  be performed directly by Movingdaycleaning.com. Cleaning services may be performed by movingdaycleaning.com’s  sub-contractors, employees or independent contractors. Movingdaycleaning.com is responsible for managing cleaning jobs that are performed by movingdaycleaning.com Contractors including: coordinating cleaning schedules, ensuring quality standards are met, monitoring staff performance, and managing contractors relationships, essentially acting as a middle ground between The Contractor(s), and The Customer, in order to ensure efficient and consistent cleaning job practices are followed across all locations. 

The Customer accepts and agrees by booking/using any of Movingdaycleaning.com services: The Customer has carefully read, understood and agreed to the Terms and Policies included on this contract. The Customer is  fully responsible for making sure that the unit/property is ready to be cleaned by The Contractor, upon The Contractor’s  arrival. The Customer is responsible (when required  by The Contractor) for completing the following pre-cleaning tasks: unplugging/disconnecting any appliances from any walls, or completing any other pre-cleaning task requirements, in order for The Contractor to fully/thoroughly complete the job. 

 

BILLING INFORMATION/ADDRESS CHANGE  

Any changes to the Customer’s billing address shall be provided to Movingdaycleaning.com within 7 days. 

 

ADDITIONAL SERVICE REQUESTS

Additional payment(s) will be due prior to starting/completing any additional service requests. 

 

BILLING AND PAYMENTS

Full Payment(s) or a minimum 50% partial payment arrangement  for any services may be automatically deducted from Thee Customer's valid (debit or credit card) card on file weekly, bi-weekly, monthly and/or prior to starting/continuing with any services. Any late payments will be charged plus 25% of the past due total balance. The Customer account may be  sent to collections, and  legal actions may be taken, if any payment(s) is more than 10 days past due. Movingdaycleaning.com  DO NOT offer any price adjustments, any discounts/credits or refunds once the contract is officially signed by The Customer. Service charges are subject to change at any time, without any prior written notice from movingdaycleaning.com, or any of its contractors. 

There's an additional 4.96% transaction charge for processing any card payments, plus any applicable state/federal taxes. Due to security/safety concerns. Movingdaycleaning.com DO NOT accept any checks, money orders, or cash payments. ANY DEPOSITS/PAYMENTS ARE NOT REFUNDABLE, AFTER THE CUSTOMER RECEIVES ANY PAYMENTS CONFIRMATION EMAIL, OR AFTER ANY PAYMENT HAS BEEN PROCESSED. 50% OF ANY DEPOSITS IS REFUNDABLE, IF THE CUSTOMER CANCELS ANY SERVICES WITHIN 1 HOUR, STARTING FROM THE DATE/TIME OF THE INITIAL BOOKING CONFIRMATION EMAIL. ANY APPLICABLE REFUNDS ARE PROCESSED WITHIN 40 BUSINESS DAYS. 

CANCELLATIONS AND REFUNDS 

The Customer will not receive any refunds/credits or payments, if The Contractor decides to stop working, or  cancel/terminate this contract do to the following: late payment, non-payment, breach of contract,  safety concerns while working on The Customer’s property, or if The Customer or any of The Customer's representatives failed to comply or violate any sections of Movingdaycleaning.com terms and policies.

 If The Customer decides to cancel this contract within the 30 days period, The Customer is automatically responsible to make any remaining payments. The Contractor will take legal actions if The Customer failed to make any required payments regarding this contract on the required date/time or due to any breach of this contract. The Contractor, will be entitled to recoup for all attorney/legal expenses incurred by The Contractor for breach of contract, or for any service interruptions caused by The Customer.  

 

SCHEDULES AND TIMELINES 

Movingdaycleaning.com will manage schedules/timelines as efficiently as possible, in order to avoid any delays. Movingdaycleaning.com and its Contractors  DO NOT GUARANTEE any schedules/timelines. Any services rescheduling is subject  to the Contractor’s availability. 

 

DELAYS AND  INFESTATION  

The Customer agrees to notify The Contractor in writing(minimum 48 hours) regarding any changes to the property’s condition or management issues  that may affect, or delay  The Contractor or any of its service providers, or any availability changes. The Customer will be responsible to pay  for any fees and full remaining payments for contracted scheduled services, if  The Customer failed to notify Movingdaycleaning.com (in writing) regarding any changes/delays.

If the Contractor arrives and the unit/property is not ready to be cleaned, The Contractor will charge a delay fee of up to $125 per hour. The Contractor is not responsible for cleaning any units/properties, if any area of the properties/units contains the following: including but not limited to: blood, feces, any animal infestation, bodily fluid, mud or for any reasons. The Contractor may choose to reschedule or cancel the entire service   considering the severity/condition of the unit/property. The Contractor will not clean any unit/property that is not in good condition, or any properties/units that DO NOT meet The Contractor’s service requirements. 

The Contractor is only responsible for cleaning properties/units that are livable, including but not limited to: properties/units that are  in compliance with state and federal laws, free from hazards. The Customer is responsible for providing a safe and comfortable environment for The Contractor to successfully complete the job.  

 

MAINTENANCE 

The Contractor will not work during any maintenance/construction. or repairs are going on the property, or while any other individuals/contractors are occupying the same property/unit. The Contractor will cancel the service, or may reschedule for a later date/time; based on The Contractor’s availability. 

 

COMPLIANCE COMPANY

The Customer is responsible to make full payments for any remaining/future contracted  services left on this contract, regardless of any property “compliance issues”, or due to any other property delays that may arise during the course of this contract.  Additional service fees, attorney fees, and/or any legal fees will apply due to any delays. 

 

CHEMICALS AND EQUIPMENT 

The Customer is responsible for providing the basic cleaning chemicals and equipment required to complete the job, additional charges will apply for renting/purchasing any special machinery/equipment and chemicals. Additional charges for any requested special machinery/equipment and special chemicals is due prior to starting/continuing with any jobs. The Contractor may cancel the job at any time without any refunds, if The Customer failed  to pay for any required special machinery/equipment and chemicals. The Customer understands and agrees that applying any chemicals to any surfaces/items is not guaranteed to not cause any damages to the surface or property. If any damages occur, The Contractor may offer a 20% percent service credit, repair or replace such surfaces/items, only up to the value of such items/surfaces. The Customer agrees that the repairs and/or replacement may not be exactly like the original, and any agreed payment arrangements between The Customer and The Contractor will be made up to twenty five percent (25%) of the current surface and/or item current value, payable or repair/replaced within a minimum of 180 days, starting from the date and time of The Customer’s (written) Claim. 

The  Customer agrees to email (info@movingdaycleaning.com) The Contractor: any allergies or sensitivities that The Customer or occupants might have, including any special products/chemicals that The Customer would like The Contractor to use, prior to booking/signing this contract or any MovingDayCleaning.com contracts. The Customer waives ALL rights to sue MovingDayCleeaaning.com or any of its service providers for any allergic reaction(s), hospitalization or death(s) from any Chemical used by The Contractor or any of MovingDayCleaning.com’s  service providers on The Customer's property, items and/or surface(s).            

 

CLAIMS AND LITIGATION

The Customer shall email any service related issues, or claims regarding Movingdaycleaning.com and any of its Contractors to: info@movingdaycleaning.com.

The Customer agrees to notify The Contractor (in writing) within 24 hours starting from the exact date/time of the incident regarding any service related issues or claims, prior to taking any legal actions, publishing any content, and/or posting any reviews. 

The Customer further agrees that he/she will not  publish/post and share any content/reviews” regarding MovingDayCcleaning.com, or any of its representatives/contractors, without first providing  a written/detailed explanation outlining the exact issue(s), including what  reasonable steps/legal actions must be taken by both parties in order to resolve such issue(s). The Customer agrees that The Contractor is entitled to recoup payments of up to $500,000 for any attorney fees/expenses, any loss/damages to MovingDayCleaning.com, or any of its  its service providers, if The Customer decides to publish/share any content/reviews or ratings,  without first coming to a mutual (written) agreement signed by first The Customer and then The Contractor. The Customer agrees once any Release Agreement(s) is signed by The Customer, The Customer automatically waives ALL rights  to sue, publish any content  or post any reviews/ratings that  MovingDayCleaning.com may find including but not limited to: inappropriate, offensive, damaging to  MovingDayCleaning.com reputation, or for any reason that may affect the movingdayxleaningg.com brand.     

The Customer agrees failure to report any incidents/issues (within 24 hours from the date/time of the incident) will be considered an automatic waiver of ALL The Customer's legal rights to take any legal actions or recoup payments for any loss/damages by The Company and/or any of its Contractors. The Customer agrees that Movingdaycleaning.com is not responsible to payout for any loss/damages, or make any repairs, if The Customer is unable to submit reasonable evidence to Movingdaycleaning.com management, (within 24 hours) starting from the date/time of the damage/loss.The Customer also agrees to submit clear video(s) and/or images proving Movingdaycleaning.com and/or contractors failing to excessive reasonable care, or acting in a negligent manner which caused the damages or loss. The Customer further agrees that failure to email (within 24 hours) clear videos, and/or images to support The Customer's claim will automatically be considered a waiver for lack of evidence by The Customer, and The Customer waives ALL rights to recoup any payments, take any legal actions against Movingdaycleaning.com or any of its third party contractors for any loss/damages. 

Movingdaycleaning.com/Contrators DO NOT GUARANTEE, or provide any INSURANCE coverages for any floor scratches, walls, dents, or cracks on floors. The Customer agrees that the Contractor who is performing the job  is directly and fully responsible to payout for any loss/damages. Movingdaycleaning.com may assist The Customer with submitting any claims to the third party. Each Contractor carries its own State and Federal required insurance. Any damage claims or service related claims may take a minimum of 180 days to process. Any litigations may take a minimum of 12 months to process.

GOVERN LAW

The Customer agrees the Court located in Essex County, New Jersey shall govern any matters or issues related to  Movingdaycleaning.com and its representatives. The Customer agrees that all attorney fees, collection fees, court fees shall be recoverable by The Contractor for breaching any part of this contract.   The Customer further agrees that failure to appear in court for any reasons, regarding any issues related to this contract will be considered an automatic waiver by The Customer and win for MovingDayCleaning.com. The Customer further agrees that failure to appear in court for any reasons, regarding any issues related to this contract will be considered an automatic waiver by The Customer and a win for MovingDayCleaning.com.
